1.1. These terms and conditions govern your use of Frush, a food delivery marketplace platform provided by Swad Hotels & Restaurants Private Limited, located at Bengaluru, India.
1.2. By using our app, you accept these terms and conditions in full. If you disagree with any part of these terms, do not use our app.
2.1. You must be at least 18 years old to use our app. By using our app, you represent and warrant that you are at least 18 years old.
2.2. You agree to use the app only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the app.
2.3. You must not misuse the app by knowingly introducing viruses, trojans, worms, logic bombs, or other material that is malicious or technologically harmful.
3.1. To access certain features of our app, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process.
3.2. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
3.3. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
4.1. By placing an order through our app, you are offering to purchase a product subject to these terms and conditions.
4.2. All orders are subject to availability and confirmation of the order price.
4.3. We reserve the right to refuse any order placed by you. If your order is accepted, we will inform you by email or through the app.
4.4. Prices for products are subject to change without notice. We reserve the right to modify or discontinue a product at any time.
4.5. Payment can be made using various payment methods available on our app. You agree to provide current, complete, and accurate purchase and account information for all purchases made via our app.
5.1. We offer delivery services in selected locations. Delivery times may vary depending on the weather and traffic conditions and availability of the products and your location. However, we will not be liable for any delays or failures in delivery caused by circumstances beyond our control.
6.1. We accept returns and offer refunds in accordance with our Return and Refund Policy, which is available on our app.
6.2. To initiate a return, you must contact our customer service team within 30 mins of order being delivered.
7.1. All content on our app, including text, graphics, logos, images, and software, is the property of Frush or its content suppliers and is protected by Indian and international copyright laws.
7.2. You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of our app without express written permission from us.
8.1. To the fullest extent permitted by law, Frush shall not be liable for any indirect, incidental, special, or consequential damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the app; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein.
9.1. You agree to indemnify, defend, and hold harmless Frush, its directors, officers, employees, consultants, agents, and affiliates from any and all third-party claims, liability, damages, and/or costs (including, but not limited to, legal fees) arising from your use of the app or your breach of these terms and conditions.
10.1. We reserve the right to modify these terms and conditions at any time. Any changes will be posted on this page and will take effect immediately upon posting.
10.2. Your continued use of the app following the posting of changes constitutes your acceptance of such changes.
11.1. These terms and conditions are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka.

13.1. FIRST 100 offer is valid only on the first order placed by a new user.
13.2. A minimum cart value of INR 200 is required to avail the discount.
13.3. Maximum discount applicable is up to INR 100.
13.4. In case of order cancellation, you will not be eligible for the discount on your next order.
13.5. The offer cannot be combined with any other ongoing promotions or discounts.
13.6. In case of returns, the refund will be processed only for the amount paid by the customer after discount.
13.7. The offer is applicable only once per user/account.
13.8. The company reserves the right to modify or withdraw the offer at any time without prior notice.
